As an H-1B visa holder, you are certainly allowed to do contract work through UpWork. In fact, many H-1B visa holders use online platforms like UpWork to find short-term or long-term projects.

There are a few things to keep in mind, however, if you plan on using UpWork as an H-1B visa holder. First, you will need to make sure that the projects you take on are in line with your H-1B visa classification. For example, if you are classified as an H-1B professional worker, the projects you take on through UpWork must be in a professional occupation.

Second, you will need to make sure that the compensation you receive for your work is in line with the prevailing wage for your occupation in the area of intended employment. The H-1B program requires that workers be paid the prevailing wage for their occupation in the area of intended employment. You can use the Department of Labor’s Prevailing Wage Determination Program to search for the prevailing wage for your occupation in the area of intended employment.

PRO TIP: If you are on an H-1B visa, you are not allowed to do any work outside of your sponsoring employer. This includes work done through online platforms such as Upwork. If you are found to be working on Upwork, your H-1B visa could be revoked and you could be deported from the United States.

Third, you will need to have a contract in place with your employer that outlines the terms and conditions of your employment. This contract should be approved by your employer and should be in compliance with all H-1B regulations.

Fourth, you will need to make sure that you maintain valid health insurance throughout your period of employment. The H-1B program requires that all workers maintain valid health insurance during their period of employment.

Finally, you will need to make sure that you comply with all other H-1B regulations, including those related to travel outside of the United States and changing employers.

If you keep these things in mind, then using UpWork as an H-1B visa holder is a great way to find short-term or long-term projects.
