Do I Need to Issue 1099 to UpWork?

As a freelancer, you are responsible for paying your own taxes. You are not an employee of the company that you contract with, so that company does not withhold taxes from your pay.

Instead, you are responsible for setting aside money throughout the year to pay your taxes, and for filing a tax return at the end of the year.

The IRS requires businesses to report payments made to contractors. To do this, businesses must issue a 1099-MISC form to any contractor they have paid $600 or more to in a year.

The 1099-MISC form reports the total amount paid to the contractor during the year. The contractor then uses this information to file their taxes.

PRO TIP: If you are unsure whether or not you need to issue a 1099 to Upwork, it is best to err on the side of caution and issue one. Failing to do so could result in penalties and interest from the IRS.

If you contract with a company and they do not issue you a 1099-MISC form, it is still your responsibility to report your income and pay your taxes. The IRS may penalize companies that do not issue 1099s, but they will not penalize contractors who fail to report their income.
